根據中國法律規定，海外華人的定義是：已經取得外國公民身份的中國人；而「華裔卡」的提案初衷是，只要是曾經持有中國國籍，且目前雙親有至少一人是中國人，即可以申請華裔卡； 據有關部門規定，這個政策對所有的海外華人有效，不過值得注意的是，這一制度目前只適用於「海外移民一代」，即從出生起就已獲得新加坡國籍的華二代、華三代，以及沒有中國國籍相關證明的混血等，無法申請華裔卡； 由此看來，「華裔卡」不同於「中國綠卡」的點在於： （一）中國綠卡的面向所有外籍人士，範圍更廣；而「華裔卡」主要針對外籍華人。 （二）中國綠卡吸引高端人才；「華裔卡」申請門檻更低。 （三）全國多個省市均可申請「中國綠卡」；「華裔卡」目前只在北京、上海等地專門地區試點施行。 如此一來，比起綠卡， 「華裔卡」是不是要容易一萬倍； 總結下來就是申請「華裔卡」的要求只有一個： 證明自己，曾是中國人； 證明爸媽，現在是中國人； that's all… 腫麼樣，so easy是不是… 這個條件可以說是灰常寬泛了… 不過，華裔卡還在試行中想獲得「華裔卡」，這類華人注意了… 相關部門負責人透露： 預計華裔卡的試點施行，將從北京中關村開始。 具體來說，中關村將開展四項試點： 1、試點移民入籍制度 使獲得永久居住資格的人員入籍更加便利； 2、試點華裔卡制度 由於中國不承認雙重國籍，對於原籍是中國的僑胞，將參考其他國家的可享受永久居留等形式； 3、試點外籍人員臨時身份證制度 例如居住6個月以上能獲得臨時身份證，可享受在華便利服務； 4、試點境外高校學生到中關村實習
